"UNTOLD 2027 - Artist Wishlist"

Art. 1 — Organizer and Official Campaign Regulation

1.1. The "UNTOLD 2027 - Artist Wishlist" campaign (hereinafter referred to as the "Campaign") is organized and carried out by UNTOLD LIVE S.R.L., a Romanian legal entity with its registered office in Cluj-Napoca, Strada G-ral Eremia Grigorescu, no. 122A, Cluj County, registered with the Trade Registry under no. J2025054909000, Tax ID: RO52210790 (hereinafter referred to as the "Organizer").

1.2. Participants in the Campaign are required to comply with the terms and conditions of this Official Campaign Regulation (hereinafter referred to as the "Official Regulation").

1.3. The Official Regulation is available free of charge to any interested person, at any time during the Campaign, by accessing the website www.untold.com, its existence being communicated on the Organizer's official social media pages and via newsletter.

1.4. The Organizer reserves the right to supplement and/or amend the Official Regulation, any such supplementation and/or amendment being made public in the manner provided under Art. 1.3 above.

Art. 2 — Legal Basis

2.1. The Campaign is organized in accordance with the provisions of Government Ordinance no. 99/2000 on the marketing of products and services, as updated, and in accordance with the applicable legislation on the matter.

Art. 3 — Territory and Duration of the Campaign

3.1. The Campaign is organized and takes place starting on 06.08.2026, at 12:00 and ends on 12.08.2026, at 19:00 (the "Campaign Period").

3.2. The Campaign takes place within the territory of Romania, exclusively online, through the Organizer's official social media accounts (including, but not limited to, Instagram, Facebook, TikTok, or other social media platforms), as well as through the newsletter sent by the Organizer to its subscribers. The Campaign may also be promoted through the website www.untold.com, as well as through the Organizer's other official communication channels.

3.3. Participation in the Campaign is carried out exclusively by completing the registration form made available by the Organizer, accessible through the links distributed on the channels mentioned in Art. 3.2 above, in accordance with the mechanism described in this Regulation.

Art. 4 — Description of the Campaign

4.1. The Campaign is organized and promoted by the Organizer exclusively through its own social media accounts and newsletter, without the involvement of any partner, influencer, content creator, or other third party.

4.2. Within the Campaign, interested persons have the opportunity to register by completing a registration form, in which they also express their preference regarding their favorite artists, thereby having the opportunity to participate in winning the prizes described in Art. 7 of this Regulation.

4.3. All participants validly registered in the Campaign, in compliance with the conditions set out in Art. 5 and the mechanism set out in Art. 6, take part in a single prize draw organized by the Organizer at the end of the Campaign Period, regardless of the date on which they registered.

4.4. Participation in the Campaign implies the full and unconditional acceptance of the provisions of this Regulation by all participants.

Art. 5 — Right to Participate

5.1. Only individuals who have reached the age of 18 as of the date of registration in the Campaign, and who follow the instructions provided in this Regulation and communicated by the Organizer, may register to participate in the Campaign. By completing the registration form, the participant declares, on their own responsibility, that they have reached the age of 18.

5.2. The following categories of persons may not participate in the Campaign:

a) employees of UNTOLD LIVE S.R.L.;

b) employees of any companies, agencies, or entities involved in the organization, administration, promotion, or conduct of the Campaign;

c) first-degree relatives of the persons mentioned in points a)-b) (namely parents/children), as well as their spouses and siblings.

5.3. Registrations that do not comply with the above conditions and the provisions of this Regulation will not be taken into account and will be removed.

5.4. Any error and/or omission regarding the personal data provided by the Participant to the Organizer shall not entail the latter's liability, the accuracy of the contact details provided by Participants being their exclusive responsibility.

5.5. Registrations submitted under the following conditions will not be taken into account:

a) if they are submitted outside the registration period, in accordance with Art. 3 above;

b) if they were made through attempted fraud, or were made in breach of any of the conditions and terms of the Regulation;

c) if they are not related to the nature and purpose of the Campaign, as detailed in this Regulation.

Art. 6 — Campaign Mechanism and Method of Registration

6.1. In order to participate in this Campaign, participants must cumulatively meet the eligibility conditions set out in Art. 5 and complete the following steps, within the Campaign Period:

Step 1. Accessing the registration form — The participant accesses the link to the registration form, distributed exclusively through the Organizer's official social media accounts and/or newsletter.

Step 2. Completing the form — The participant completes the registration form with the following details: full name, phone number, e-mail address, gender, county of residence, and age.

Step 3. Selecting favorite artists — Within the same form, the participant expresses their preference regarding their favorite artists, from a list made available by the Organizer.

Step 4. Registration in the Campaign — After submitting the form, the participant is registered in the Campaign database and automatically enters the single prize draw organized at the end of the Campaign Period, in accordance with Art. 6.2 below.

6.2. The Campaign takes place as follows:

- Period 6 – 12 August 2026: the registration period, during which participants complete the dedicated form;

- 14 August 2026: the prize draw is carried out, through the Random.org platform, to designate the winners, in accordance with Art. 7 below.

 

Art. 7 — Prizes and Their Award

7.1. (1) The Organizer will award, within this Campaign, a total of six (6) prizes, consisting of:

- one (1) General Access (GA) double ticket for 4 days — UNTOLD 2027;

- two (2) prizes consisting of 50 EUR credit for wristband top-up — UNTOLD 2027;

- one (1) Backstage Experience — UNTOLD 2027;

- one (1) Meet & Greet with an artist chosen by the Organizer — UNTOLD 2027;

- one (1) Front of House Experience — UNTOLD 2027.

(2) In total, six (6) winners will be designated within the Campaign, each winner receiving a single prize from among those mentioned above.

7.2. The designation of the six (6) winners will be carried out by prize draw, organized by the Organizer through the Random.org platform, by random selection, on 14 August 2026, among all participants validly registered in the Campaign, in compliance with the conditions set out in Art. 5 and Art. 6.

7.3. The six (6) winners will be contacted by the Organizer exclusively by e-mail, at the address provided in the registration form, in order to validate and confirm the win, as well as to request the information necessary for awarding the prize. The Organizer will not publish the winners' names and will not make any public announcement, on any communication channel (social media, website, newsletter, or others), regarding their identity.

7.4. The other participants, who were not designated as winners, will not be notified of the result of the prize draw.

7.5. The estimated value of the prizes is 1,880 lei.

7.6. Participants in the Campaign are not required to bear any additional direct or indirect costs.

7.7. No prize may be exchanged for or replaced with another prize within this Campaign.

7.8. If the winner cannot be contacted for reasons not attributable to the Organizer, or is contacted but does not respond within 3 (three) days to the e-mail sent, or does not provide the information requested for awarding the prize, or refuses to accept the prize won, they will forfeit the right to receive the prize.

7.9. Prizes will be awarded/communicated by e-mail, within a maximum of 60 days from the date of the prize draw, after the winner has been validated in accordance with the procedure above. If the e-mail address provided to the Organizer is not valid or functional, the winner will forfeit the right to claim the prize.

7.10. The cash equivalent of the prize won within this Campaign may not be awarded, nor may the prize offered be exchanged. Furthermore, if, for any reason, the UNTOLD Festival does not take place in 2027, the winner will not be entitled to payment of the lei equivalent of the value of the prize won, and its validity will not be extended for subsequent editions.

7.11. The Organizer reserves the right to supplement the prizes offered during the Campaign.

Art. 8 — Liability and Obligations

8.1. The Organizer does not assume any responsibility and will not be named a party to any dispute regarding ownership rights over the prizes awarded within the Campaign.

8.2. The Organizer is entitled to take all necessary measures in the event of an attempt to defraud the system, abuse, or any other attempts that could affect the image of this Campaign.

8.3. The Organizer of the Campaign will have no liability and may not be involved in any dispute related to the holding or ownership of the prizes received, nor with regard to any additional expenses incurred by the Participant in connection with this Campaign.

8.4. In the event of any uncertainty regarding the validity of documents sent by participants for the purpose of registering for this Campaign, the Organizer's decision is final. The Organizer does not assume responsibility for:

a) any error in the data provided by participants; inaccurate contact details do not entail the Organizer's liability, it being the exclusive responsibility of Participants to ensure that such details were correctly provided;

b) the blocking of a Participant's e-mail address or any irregularity concerning it;

c) situations in which certain persons registered in the Campaign are unable to participate in the Campaign or do not meet the Campaign's conditions, if such inability or failure to meet the conditions is due to circumstances beyond the Organizer's control;

d) any disputes between Participants relating to rights over e-mail addresses;

e) a Participant's inability to benefit from the prize due to failure to fully comply with the Campaign Regulation and/or due to erroneous name and/or surname and/or other data submitted.

8.5. These circumstances may be due to: erroneous or incomplete information, transmitted with interruptions, or transmitted late due to Participants, malfunctioning or defective operation of e-mail, whether on the part of the Organizer or the Participant, caused by technical issues and/or heavy traffic on the website.

8.6. Participants expressly, unequivocally, and definitively accept all decisions made by the Organizer regarding the manner of organizing and conducting the Campaign and the prizes awarded, as well as the subsequent Campaign schedule or other changes related to the implementation of the Campaign.

8.7. All disputes regarding ownership rights over the prizes will not affect the principle whereby the Organizer awards the prize to the person who complies with the provisions of this Official Regulation. From the moment the prize is received by the winner, the Organizer is released from any obligation towards the Participant.

Art. 9 — Disputes and Applicable Law

9.1. Any disputes arising between the Organizer, on the one hand, and any of the Participants, on the other hand, will be resolved amicably or, if this is not possible, disputes will be settled by the competent court in the city of Cluj-Napoca, where the Organizer is headquartered, in accordance with common law.

9.2. The applicable law is Romanian law.

Art. 10 — Taxes and Duties

10.1. The Organizer undertakes to withhold and remit the tax due on income consisting of the prizes awarded to winners, in accordance with Art. 110 para. (1) of the Fiscal Code (Law no. 227/2015, as subsequently amended) for winners who are Romanian citizens and tax residents in Romania, and, respectively, in accordance with the provisions of Title VI of the same Fiscal Code regarding income obtained from Romania by non-resident individuals, corroborated, as applicable, with the applicable double taxation treaty, for winners who are non-tax-residents, any other obligations of any other nature in connection therewith being the exclusive responsibility of the winners.

Art. 11 — Processing of Personal Data

11.1. Who carries out the processing? The personal data of Campaign participants will be processed by the Organizer, in compliance with the applicable legislation, in particular Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data ("GDPR").

11.2. Categories of personal data processed within the Campaign: full name, phone number, e-mail address, gender, county of residence, and age.

11.3. The purpose of the processing is strictly related to the conduct of the Campaign (organization and conduct, designation and validation of winners, awarding of the prize, as well as fulfillment of the Organizer's tax and financial-accounting obligations). The data will thus be processed for the conduct of the Campaign in accordance with the mechanism described in this Regulation (this constituting the "contract" between the Organizer and the participants who voluntarily registered) or for the fulfillment of legal obligations incumbent upon the controller (e.g., fulfillment of tax obligations).

11.4. Legal basis for the processing:

a) performance of the contract represented by the terms and conditions established through the Regulation and considered accepted as a result of participation;

b) the controller's legitimate interest in connection with conducting contests/promotional campaigns and defending the controller's rights and interests;

c) fulfillment of the applicable legal obligations for the calculation, declaration, and awarding of the prize.

The personal data is necessary for participation in the Campaign and its conduct with respect to the participant. Any refusal to provide personal data results in the impossibility of participating in the Campaign, at various stages at which such a refusal may occur.

11.5. The retention period for personal data is determined in accordance with the UNTOLD Privacy Policy.

11.6. Since this Campaign is communicated, among other means, through the Facebook and Instagram social media platforms, participants may consult the following pages to learn details about the processing of personal data by these platforms: https://help.instagram.com/155833707900388 and https://www.facebook.com/privacy/policy/. Participants who subscribe to the Organizer's newsletter are informed separately, at the time of subscription, about the processing of data for direct marketing purposes, in accordance with the applicable privacy policy.

11.7. Participants have, in relation to the controller/its processors, the rights conferred by law, namely the right to information, the right of access to data, the right to intervene with respect to data, the right to object to the collection and processing of personal data, the right not to be subject to an automated individual decision, and the right to apply to the courts and/or to the National Supervisory Authority for Personal Data Processing. Art. 12 — Termination of the Campaign

12.1. This Campaign may terminate in the event of an occurrence constituting force majeure, including in the event of the Organizer's impossibility, for reasons beyond its control, to continue the Campaign.

12.2. Force majeure, agreed to be the unforeseeable and insurmountable event, occurring after this Official Regulation enters into force, which prevents the party or parties from fulfilling their contractual obligations, releases from liability the party invoking it, for the duration of the force majeure event.

12.3. If a force majeure situation, including the Organizer's impossibility for reasons beyond its control, prevents or delays, in whole or in part, the performance of the Official Regulation and the continuation of the Campaign, the Organizer will be released from liability for the fulfillment of its obligations for the period during which such fulfillment is prevented or delayed, in accordance with Art. 1082 and 1083 of the Civil Code.

12.4. If it invokes force majeure, the Organizer is obliged to notify Campaign participants of its existence, within 5 (five) business days of the occurrence of the force majeure event.

Art. 13 — Other Provisions

13.1. The Organizer's decisions regarding the Campaign are final and binding on all Participants.

13.2. An unawarded prize will remain in the Organizer's possession, which may freely dispose of it in the manner it considers necessary or suited to its interests.

13.3. The Organizer is entitled to take all necessary measures in the event of an attempt to defraud the system, abuse, or any other attempts that could affect the image or the costs involved in organizing and conducting the Campaign.
