“TOP-UP100” CAMPAIGN

 

Art. 1 - Organizers and Official Rules of the Campaign

1.1 The “TOP-UP100” Campaign is organized and run by UNTOLD PRODUCTION S.R.L., a Romanian legal entity with headquarters in mun. Cluj-Napoca, str. G-ral Eremia Grigorescu nr. 122A, jud. Cluj, registered at the Commercial Register of the Cluj Court under no. J12/5129/2021, Unique European Unique Identifier (EUID) ROONRC. J12/5129/2021, with CUI RO45114420.

1.2. The decision to run the Campaign in accordance with the rules of these Rules (hereinafter referred to as the “Official Rules”) is final and binding on the Participants.

1.3. Participants in the Campaign are bound by the terms and conditions of these Official Rules of the Campaign (hereinafter referred to as the “Official Rules”).

1.4. The Official Rules are available free of charge to any interested person at any time during the Campaign by visiting the website www.untold.com and will be communicated on the Organizer's official social media pages.

1.5. The Organizer reserves the right to add to and/or amend the Official Rules, the addition and/or amendment shall be notified to the public in the manner provided for in art. 1, para. (4). 

 

Art. 2 - Legal basis

2.1. The campaign is organized in accordance with the provisions of Government Ordinance no. 99/2000, on the marketing of products and services on the updated market and in accordance with the relevant legislation.

 

Art. 3 - Territory and duration of the Campaign

3.1. The Campaign is organized and runs from 09.07.2025 and ends on 16.07.2025 (“Campaign Period”).

3.2 The Campaign will take place on the territory of Romania, through the Organizer's official social media pages.

 

Art. 4 - Campaign Description

4.1. The publicity lottery is called “TOP-UP 100” and allows access to the draw for prizes following a minimum Top-up of 100 LEI through a VISA card in the Untold 2025 festival account.

4.2. Participants will also receive a drink from the Organizer, either Madri or Pepsi, depending on the participant's preference and age.

4.2 Participants must also agree to the terms and conditions of these Rules.

 

Art. 5 - Right to participate

5.1. Only individuals who follow the instructions provided in these Rules may register to participate in the Campaign.

5.2. Minors under the age of 16 may participate in the Campaign only if they submit a parental consent form in which the parent or person having guardianship of the minor expressly agrees that the minor may register and participate in the Campaign. This agreement must be signed and sent to the following address: [email protected] before the minor registers.

5.3 The following categories of persons may not participate in the Campaign:

a) employees of Untold Production S.R.L.;

b) employees of any companies involved in carrying out any activities related to the organization and conduct of the Campaign;

c) relatives of the above-mentioned employees (i.e. children/parents, brothers/sisters/sisters-in-law, spouse) are not entitled to participate in the Campaign.

5.4 Entries that do not comply with the above conditions and the provisions of these Rules will not be taken into consideration and will be eliminated.

5.5. Any error and/or omission in the personal data provided by the Participant to the Organizer shall not entail the liability of the Organizer, the accuracy of the contact details provided by the Participants being the sole responsibility of the Participants.

5.6 Entries submitted under the following conditions will not be considered:

(a) If they are submitted outside the Entry Period as set out in Article 3 above;

b) If they have been made by attempted fraud, or have been made in breach of any of the conditions and terms of the Regulations;

c) They do not relate to the nature and purpose of the Campaign as detailed in these Rules. 

 

Art. 6 - Mechanism of the Campaign and how to enter the Campaign

6.1 In order to participate in this Campaign, participants must comply with the following mechanism:

a) The Participant must deposit the minimum amount of 100 LEI into the TOP UP Untold 2025 festival account.

b) The account must necessarily be funded by using a VISA bank card;

 

Art. 7 - Prize and Awarding

7.1 The Organizer will draw 15 winners and offers the following as prize:

- 5 Exclusive experiences consisting of Back of the stage and front of house access;

- 5 Access to the Secret Garden, double invitation allowing one companion;

- 5 Festival Brunch at the Radisson Blue Hotel, double invitation allowing one accompanying person on 10 August 2025.

7.2. Prizes will be awarded by analysis of the submitted materials and selection of the winners by a jury composed of the Organizer.

7.3 The organizer will announce only the winners of the campaign in the campaign announcement post in the comments on 17.07.2025. Other participants will not be contacted.

7.4 The Organizer will contact the winners in order to request the necessary information for the prize submission. Winners will be contacted a maximum of 3 times, at an interval of approximately 2 working days. In case one of the winners does not respond within the mentioned deadline, the reserves will be contacted according to the number of the draw. The same applies to all winners.

7.5. The value of the prize is 11,370 EUR.

7.6. No additional direct or indirect direct or indirect expenses of any kind are imposed on participants in the Campaign.

7.7. No cash equivalent of the prize offered in this Campaign may be awarded, exchanged or offered for another prize.

 

Art. 8 - Liability and Obligations

8.1 The Organizer does not assume any liability and will not be named as a party in any dispute of any kind regarding the ownership of the benefits awarded in the Campaign.

8.2. The Organizer is entitled to take all necessary measures in case of any attempt to defraud the system, abuse or any other attempts that could damage the image of this Campaign.

8.3. The Campaign Organizer shall have no liability and shall not be involved in any dispute related to the possession or ownership of the Prize received, as well as in respect of any additional expenses incurred by the Participant in connection with this Campaign.

8.4 In the event of any doubt as to the validity of the documents sent by the Participants in order to enter this Campaign, the Organizer's decision is final. The organizer accepts no responsibility for:

(a) Any errors in the data provided by the Participants; the lack of correctness of the contact details does not entail the liability of the Organizer, it being the sole responsibility of the Participants to ensure that they have been correctly provided.

b) The blocking of the Participant's e-mail address or any irregularity in relation thereto;

c) Situations in which certain persons entered in the Campaign are unable to participate in the Campaign or do not meet the conditions of the Campaign, if this inability or failure to meet the conditions is due to circumstances beyond the control of the Organizer;

d) Any disputes between Participants concerning rights to e-mail addresses.

e) The inability of a Participant to benefit from the prize due to non-compliance, in full, with the Rules of the Campaign and or due to the name and/or surname and/or incorrect data submitted.

8.5 These circumstances may be due to: erroneous, incomplete, interrupted or late information transmitted due to the Participants, malfunction / malfunction of the e-mail, either in the case of the Organizer or the Participant, caused by technical problems and/or heavy traffic on the website.

8.6 The Participants expressly, unequivocally and definitively accept all decisions made by the Organizer regarding the manner of organization and conduct of the Campaign and the Prizes awarded, as well as the subsequent timing of the Campaign or other changes related to the implementation of the Campaign.

8.7. Any disputes regarding the ownership of prizes shall not affect the principle that the Contest Organizer will award prizes to persons who comply with the provisions of these Official Rules. From the moment the Prize is received by the Winner, the Organizer is released from any obligation towards the Participant.

 

Art. 9 - Disputes and applicable law

9.1. Any disputes arising between the Organizer, on the one hand, and any of the Participants, on the other hand, will be settled amicably or, if this is not possible, the disputes will be settled by the competent court of Cluj-Napoca, at the Organizer's headquarters, in accordance with common law.

9.2. The applicable law is the Romanian law. 

 

Art. 10 - Fees and taxes

10.1. The Organizer is obliged to withhold and remit the tax due for the income consisting of the prizes awarded to the winners with Romanian citizenship in accordance with the provisions of art. 110 paragraph (1) of the Tax Code approved by Law 227 of 2015, with subsequent amendments and additions, any other obligations of any other nature, in connection therewith, being the exclusive responsibility of the winners.

 

Art. 11. - Processing of personal data

11.1. Who carries out the processing? The personal data of the participants to the Campaign will be processed by the Organizer in compliance with the applicable legislation, in particular the EU Regulation 2016/679 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (“GDPR”).

11.2 Categories of personal data processed for the Campaign: name, surname, telephone number, email address, voice.

11.3. The purpose of the processing is strictly related to the running of the competition (organization and conduct, designation and validation of winners, awarding of prizes, as well as the fulfillment of the organizer's fiscal and financial accounting obligations). The data will thus be processed for the purposes of running the campaign in accordance with the mechanism described in the Regulation (the latter representing the “contract” between the organizer and the participants who have voluntarily entered) or for the performance of legal obligations incumbent on the controller (e.g. fulfilling tax obligations).

11.4. Legal basis for processing: 

a) The performance of the contract represented by the terms and conditions established by the Regulation and deemed accepted as a result of participation 

b) Legitimate interest of the operator in connection with the organization of contests/promoted campaigns and for the defense of the rights and interests of the operator 

c) fulfillment of the applicable legal requirements for the calculation, declaration and awarding of prizes 

Personal data is necessary for us to participate in the contest and to carry out the contest as far as the participant is concerned. A possible refusal to provide personal data entails the impossibility to participate in the contest, in the various phases in which a refusal may occur.

11.5 The period of storage of personal data is carried out according to the Untold Privacy Policy.

11.6 As the communication of this campaign is carried out via the Instagram and Facebook platforms, participants can consult the following pages for details on the processing of personal data https://help.instagram.com/155833707900388 and https://www.facebook.com/privacy/policy/ respectively.

11.7. Participants have, in relation to the operator/its representatives, the rights conferred by law, namely the right to information, the right of access to data, the right to intervene on the data, the right to object to the collection and processing of personal data, the right not to be subject to an individual decision and the right to apply to the courts and/or the National Supervisory Authority for the Processing of Personal Data. Art. 12 - Campaign termination

12.1 This Campaign may be terminated in the event of the occurrence of an event constituting force majeure, including in the event of the Organizer's inability, for reasons beyond its control, to continue the Campaign.

12.2. Force majeure, agreed as an unforeseeable and unforeseeable event occurring after the entry into force of these Official Rules and which prevents the party or parties from fulfilling their contractual obligations, exempts the party invoking it from liability for the duration of the force majeure.

12.3 If a situation of force majeure, including the impossibility of the Organizer for reasons beyond its control, prevents or delays in whole or in part the execution of the Official Rules and the continuation of the Campaign, the Organizer will be exempt from liability for the performance of its obligations for the period during which this performance is prevented or delayed, according to Articles 1082 and 1083 of the Civil Code. 12.4 In the event that the Organizer invokes force majeure, the Organizer is obliged to notify the participants in the Campaign of its existence within 5 (five) working days of the occurrence of the case of force majeure.        

 

Art. 13 - Other Clauses

13.1. The Organizer's decisions regarding the Campaign are final and applicable to all Participants.

13.2. Prizes not awarded shall remain in the possession of the Organizer, who may dispose of them freely in the manner it deems necessary or appropriate to its interests.

13.3. The Organizer is entitled to take all necessary measures in case of attempted fraud of the system, abuse or any other attempts that could affect the image or the costs involved in the organization and running of the Campaign.
