Art. 1 - Organizers and Official Rules of the Campaign

1.1 The campaign “Globalworth - Untold 2025” is organized and run by UNTOLD PRODUCTION S.R.L., a Romanian legal entity with headquarters in mun. Cluj-Napoca, str. G-ral Eremia Grigorescu nr. 122A, jud. Cluj, registered at the Commercial Register of the Cluj Court under no. J12/5129/2021, Unique European Unique Identifier (EUID) ROONRC. J12/5129/2021, having CUI RO45114420, as Organizer and in partnership with GLOBALWORTH ASSET MANAGERS S.R.L., a limited liability company, with registered office in Bucharest, str. Barbu Vacarescu nr. 201, str. Barbu Vacarescu, 26th floor, room 1, sector 2, registered at the Trade Register of Bucharest under no. J40/17685/2006, Unique Registration Code 14757841, as Partner

1.2. The decision to run the Campaign according to the rules of this Regulation (hereinafter referred to as the “Official Rules”) is final and binding for the Participants.

1.3. The Participants in the Campaign are obliged to comply with the terms and conditions of these Official Rules of the Campaign (hereinafter referred to as “Official Rules”).

1.4. The Official Rules are available free of charge to any interested person, at any time during the Campaign, by visiting the website https://untold.com/info/09372463-d16b-46db-8ccf-e2975109d75 and will be communicated on the official social media pages of the Organizer.

1.5. The Organizer reserves the right to add to and/or amend the Official Rules, the addition and/or amendment shall be made public in the manner provided for in art. 1, para. (4).  

 

Art. 2 - Legal basis

2.1. The Campaign is organized in accordance with the provisions of Government Ordinance no. 99/2000, on the sale of products and services on the updated market and in compliance with the relevant legislation.

 

Art. 3 - Territory and duration of the Campaign

3.1. The Campaign is organized and runs from 09.07.2025 at 10:00 a.m. and ends on 16.07.2025 at 11:59 p.m. (“Campaign Period”).

3.2. The Campaign takes place in Romania and is conducted online through the https://untold.com/info/09372463-d16b-46db-8ccf-e2975109d75  website. It is communicated on the aforementioned website, as well as on the official social media pages (Instagram and Facebook) of the Organizer as well as through the Newsletter issued by the Organizer.

 

Art. 4 - Description of the Campaign

4.1 The object of the campaign “Globalworth - Untold 2025” is to promote the Untold 2025 Festival and the Globalworth tenant community by organizing a unique experience in the specially designed Globalworth area of the Untold 2025 Festival.

4.2 Entrants must also agree to the terms and conditions of these Regulations.

 

Art. 5 - Right to participate

5.1. Only individuals who hold a ticket or an invitation to the Untold Festival 2025 and follow the instructions provided in these Regulations may register to participate in the Campaign.

5.2 The following categories of persons may not participate in the Campaign:

a) employees of Untold Production S.R.L.;

b) employees of any companies involved in carrying out any activities related to the organization and running of the Campaign;

c) relatives of the above-mentioned employees (i.e. children/parents, brothers/sisters/sisters-in-law, spouse) are not entitled to participate in the Campaign.

5.3 Entries that do not comply with the above conditions and the provisions of these Rules will not be taken into consideration and will be eliminated.

5.4. Any error and/or omission regarding the personal data provided by the Participant to the Organizer shall not entail the latter's liability, the accuracy of the contact details provided by the Participants being the sole responsibility of the Participants.

5.5 Entries submitted under the following conditions will not be considered:

(a) If they are submitted outside the Entry Period as set out in Article 3 above;

b) If they have been made by attempted fraud, or have been made in breach of any of the conditions and terms of the Regulations;

c) They do not relate to the nature and purpose of the Campaign as detailed in these Rules.

Art. 6 - Mechanism of the Campaign and how to enter the Campaign

6.1 In order to participate in this Campaign, participants must comply with the following mechanism:

a) The Participant must hold a ticket or invitation for access to the Untold Festival 2025. 

b) The Participant, as an individual, must be in an employment relationship or similar form of collaboration with a legal entity that is a Tenant in relation to the Globalworth Partner for any of the office buildings in the Globalwortg portfolio. For clarity, a list of the Partner's buildings is set out below:

c) The Participant must complete the registration form made available under art. 3.2. with the following conditions: (i) the e-mail address used for registration must be within the e-mail domain of one of the Globalworth Tenants (as per art. 6.1.a above). For clarity, the e-mail addresses used for the employment relationship/similar relationship will be used for the campaign registration and (ii) the company where the Participant has his/her employment relationship/similar relationship must be expressly mentioned.

6.2 Failure to comply with the above conditions will invalidate the entry.

 

Art. 7 - Prize and Award

7.1. The Organizer will award 100 (one hundred) winners who will each win a double invitation that will give them only the access to the dedicated Globworth platform at the Festival.  Winners will be declared the first 100 validated participants in order of registration. Due to the specific nature of the prize, no commercial value can be attributed to it.

7.2. The organizer will announce only the winners of the campaign in the campaign announcement post in the comments on 23.07.2025 and by a confirmation email. Other participants will not be contacted.

Winners will be required to confirm receipt of the prize confirmation email within 24 hours. They will be contacted by e-mail a maximum of 3 times, at an interval of approximately 2 working days. If one of the winners does not reply within this time limit, the reserves will be contacted in the order of the entries. The same applies to all winners.

7.3. No additional direct or indirect direct or indirect costs are imposed on participants in the Campaign. 

7.4. No cash equivalent of the prize offered in this Campaign may be awarded, exchanged or offered for another prize. 

7.5. Access to the Globalworth dedicated platform during the Festival by the winners will be made by presenting the prize confirmation email. The Organizer may carry out checks in order to block possible attempts to circumvent the access rules (e.g. use of the same invitation by more than one person). The Winner may be required by the Organizer to present proof of identity in order to prove the veracity of the identity at the time of access to the Globalworth Partner's dedicated platform.

 

Art. 8 - Liability and Obligations

8.1 The Organizer is entitled to take all necessary measures in case of attempted fraud of the system, abuse or any other attempts that could damage the image of this Campaign.

8.2. The Campaign Organizer shall have no liability and shall not be involved in any dispute related to the possession or ownership of the Prize received, as well as in respect of any additional expenses incurred by the Participant in connection with this Campaign.

8.3 The Organizer accepts no responsibility for: 

(a) any errors in the details provided by the Entrants; incorrect contact details do not incur the liability of the Organizer and it is the sole responsibility of the Entrants to ensure that they have been correctly provided.

b) The blocking of the Participant's e-mail address or any irregularity in relation thereto;

c) Situations where certain persons entered in the Campaign are unable to participate in the Campaign or fail to meet the conditions of the Campaign, if such inability or failure to meet the conditions is due to circumstances beyond the control of the Organizer;

d) Any disputes between Participants concerning rights to e-mail addresses.

e) The inability of a Participant to benefit from the prize due to failure to comply, in full, with the Rules of the Campaign and or due to the name and/or surname and/or incorrect data submitted.

8.4. These circumstances may be due to: erroneous, incomplete, interrupted or late information due to the Participants, malfunction / malfunction of the e-mail, either in the case of the Organizer or the Participant, caused by technical problems and / or heavy traffic on the website.

8.5 The Participants expressly, unequivocally and definitively accept all decisions taken by the Organizer regarding the manner of organization and conduct of the Campaign and the Prizes awarded, as well as the subsequent timing of the Campaign or other changes related to the implementation of the Campaign. 

8.6 Any disputes regarding the ownership of the prizes shall not affect the principle that the Contest Organizer will award the prizes to persons who comply with the provisions of these Official Rules. From the moment the prize is received by the winner, the Contest Organizer is released from any obligation towards the Participant.

 

Art. 9 - Disputes and applicable law

9.1. Any disputes arising between the Organizer, on the one hand, and any of the Participants, on the other hand, will be settled amicably or, if this is not possible, the disputes will be settled by the competent court of Cluj-Napoca, at the Organizer's headquarters, in accordance with common law.

9.2. The applicable law is the Romanian law. 

 

Art. 10 - Fees and taxes

10.1. To the extent applicable, the Organizer undertakes to withhold and remit the tax due for the income consisting of prizes awarded to winners with Romanian citizenship in accordance with the provisions of art. 110 paragraph (1) of the Tax Code approved by Law 227 of 2015, with subsequent amendments and additions, any other obligations of any other nature, in connection therewith, being the exclusive responsibility of the winners.

 

Art. 11. - Processing of personal data

11.1. Who carries out the processing? The personal data of the participants to the Campaign will be processed by the Organizer in compliance with the applicable legislation, in particular the EU Regulation 2016/679 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (“GDPR”). For the avoidance of doubt, the Globalworth partner does not have access to the data of the participants or winners and does not process personal data in any way in connection with the Campaign. 

11.2. Categories of personal data processed within the Campaign: Name, surname, and e-mail address.

11.3. The purpose of the processing is strictly related to the running of the competition (organization and running, designation and validation of the winners, awarding of prizes, as well as the fulfillment of the organizer's fiscal and financial accounting obligations). The data will thus be processed for the purposes of running the campaign in accordance with the mechanism described in the Regulation (the latter representing the “contract” between the organizer and the participants who have voluntarily entered) or for the performance of legal obligations incumbent on the controller (e.g. fulfilling tax obligations).

11.4. Legal basis for processing: 

a) The performance of the contract represented by the terms and conditions established by the Regulation and deemed accepted as a result of participation 

b) Legitimate interest of the operator in connection with the organization of contests/promoted campaigns and for the defense of the rights and interests of the operator 

c) fulfillment of the applicable legal requirements for the calculation, declaration and awarding of prizes 

Personal data is necessary for us to participate in the contest and to carry out the contest as far as the participant is concerned. A possible refusal to provide personal data entails the impossibility to participate in the contest, in the various phases in which a refusal may occur.

11.5 The period of storage of personal data is carried out according to the Untold Privacy Policy.

11.6 As the communication of this campaign is carried out through the Instagram and Facebook platforms, participants can consult the following pages for details on the processing of personal data https://help.instagram.com/155833707900388 and https://www.facebook.com/privacy/policy/.

11.7. Participants have, in relation to the operator/its agents, the rights conferred by law, namely the right to information, the right of access to data, the right to intervene on data, the right to object to the collection and processing of personal data, the right not to be subject to an individual decision and the right to apply to the courts and/or the National Supervisory Authority for the Processing of Personal Data. Art. 12 - Campaign termination

12.1 This Campaign may be terminated in the event of the occurrence of an event constituting force majeure, including in the event of the Organizer's inability, for reasons beyond its control, to continue the Campaign.

12.2. Force majeure, agreed as an unforeseeable and unforeseeable event occurring after the entry into force of these Official Rules and which prevents the party or parties from fulfilling their contractual obligations, exempts the party invoking it from liability for the duration of the force majeure.

12.3 If a situation of force majeure, including the impossibility of the Organizer for reasons beyond its control, prevents or delays in whole or in part the execution of the Official Rules and the continuation of the Campaign, the Organizer will be exempt from liability for the performance of its obligations for the period during which this performance is prevented or delayed, according to Articles 1082 and 1083 of the Civil Code. 12.4 In the event that the Organizer invokes force majeure, the Organizer is obliged to notify the participants in the Campaign of its existence within 5 (five) working days of the occurrence of the case of force majeure.        

 

Art. 13 - Other Clauses

13.1. The Organizer's decisions regarding the Campaign are final and applicable to all Participants.

13.2. Prizes not awarded shall remain in the possession of the Organizer, who may dispose of them freely in the manner it deems necessary or appropriate to its interests.

13.3. The Organizer is entitled to take all necessary measures in case of attempted fraud of the system, abuse or any other attempts that could affect the image or the costs involved in the organization and running of the Campaign.
